DELIVERY
1. Forms of delivery/receipt of the order
When ordering a product in the online shop, the user can choose one of the following delivery options:
- Delivery shall be made to the address specified by the customer when placing the order and shall be carried out for KSHAMA d.o.o. by the Post of Slovenia or by the delivery service GLS, DPD or Fedex.
2. Delivery prices
We deliver throughout the Republic of Slovenia. It is not possible to choose the delivery service, KSHAMA d.o.o. decides which delivery service will send the parcel.
The price for delivery in the whole of the Republic of Slovenia is € 3.80 + € 1.00 for cash on delivery.Â
If the buyer chooses to collect the order in person at the address, the collection is free of charge.
Delivery prices are subject to change at any time without notice. In the event of special promotions, the delivery price may be subject to change regardless of the price list in force at the time. The user shall be informed of the amount of the delivery charge before the order is completed.
The delivery price or postage costs are clearly visible on the "Shopping basket" page, as well as on the "Checkout" or "Completion of purchase" page.
The postage price also includes all other handling and cash transfer costs, so the postman may not charge you any extra fees upon delivery. Your payment amount will be the amount you received on the confirmation invoice in your e-mail.
3. Delivery date
The estimated time within which KSHAMA d.o.o. will hand over the selected products to the delivery service is indicated next to each product and in the order basket. In the case of orders for several products with different delivery times, the longest time limit will be taken into account. Delivery is arranged by the delivery service, in most cases on the next working day from the day of dispatch, but within 7 working days at the latest.
Due to increased order volumes during seasonal reductions, delivery times may be extended by 10 working days.
The deadline for dispatch starts when the order is confirmed by the online shop or on the first working day after the order is placed.
4. Personal collection
When the order is ready for collection at the address, the buyer will be notified by e-mail. The package will be waiting in the shop for 3 working days from the date of receipt of the ready notification.
After the expiry of the period during which the package is waiting for collection, the order is deemed cancelled.
If, for various reasons, the customer is unable to collect the package within this time limit or needs a longer time limit, he/she must inform the shop directly (e-mail: info@brandspot.si).
5. Details of delivery to the address of your choice
In the event that no one is present at the address at the time of delivery, the delivery service shall inform the recipient at which collection point the package can be collected.
In the case of delivery by delivery service and payment upon delivery to the delivery service, the Buyer shall pay the additional order processing costs charged by the delivery service. With a delivery service, payment on delivery may be made by cash or by payment card.
In the case of delivery to a multi-apartment building, the package is delivered to the front door of the multi-apartment building.
6. Right of withdrawal, return of goods
The consumer has the right to notify the company (email: info@brandspot.si) within 14 days of taking delivery of the goods that he/she wishes to withdraw from the contract, without having to give a reason for his/her decision. Regardless of the form of cancellation, the consumer must provide the company with a copy of the invoice.
The goods must be returned to the Seller within 14 days of the date of the cancellation of the contract (purchase). The time limit starts one day after the date of receipt of the goods ordered.
The goods received must be returned undamaged, unused and in their original packaging. If the product has been opened and used within this period, it cannot be returned.
The Company shall return all payments received to the Buyer using the same means of payment as used by the Buyer, unless the Buyer expressly requests the use of another means of payment and the Buyer incurs no costs as a result. Refunds of payments made shall be made immediately or, at the latest, within 14 days of receipt of the notice of withdrawal. The company may withhold payment until it has received the returned goods or until the consumer has sent proof that he has sent the goods back, whichever occurs first.

If, upon receipt of the consignment, it is found that the consignment (parcel) or product is damaged or shows signs of opening, the Buyer is obliged to initiate a complaint procedure directly with the delivery company (Pošta Slovenije, d.o.o.) immediately, and at the latest within 14 days of receipt.
7. Awareness of the company's liability for material defects
The Consumer Protection Act (CPA) stipulates that the seller must deliver the goods to the consumer in accordance with the contract and is liable for material defects in its performance.
The error is factual:
- if the item does not have the characteristics necessary for its normal use or circulation;
- if the item does not have the characteristics necessary for the particular use for which the buyer is buying it, which were known or should have been known to the seller;
- if the object lacks the qualities and characteristics that were expressly or tacitly agreed or prescribed;
- if the seller has handed over an item that does not match the sample or model, unless the sample or model was shown only for information.
The suitability of the goods for normal use shall be judged by reference to normal goods of the same type and taking into account any representations made by the seller or the manufacturer about the characteristics of the goods, in particular by advertising, product presentation or claims made on the goods themselves. Liability for material defects shall be governed by the provisions of the law governing contractual relations, unless otherwise provided in this Law.
The consumer can exercise his rights under the material defect law if he notifies the seller of the defect within two months of the date on which the defect was discovered. In the notification of the defect, the consumer must describe the defect in more detail and give the seller the opportunity to inspect the item. The consumer may give notice of the defect to the seller in person, with a receipt from the seller, or by sending it to the shop where the goods were bought or to the seller's agent with whom the consumer has concluded a contract.
The Seller is not liable for material defects in the goods which become apparent after two years have elapsed since the goods were handed over. A defect in the goods shall be deemed to have existed at the time of delivery if it appears within six months of delivery.
A consumer who has duly notified the seller of a defect has the right to require the seller to:
- rectify a defect in the goods; or
- refund a proportion of the amount paid in proportion to the defect; or
- replace the defective goods with new, faultless goods; or
- refund the amount paid.
In any event, the consumer shall also have the right to claim compensation from the seller for damages, in particular for the costs of materials, spare parts, labour, transfer and transport of the products, incurred as a result of the fulfilment of the obligation referred to in the preceding paragraph of this Article. The consumer's rights referred to in paragraph 1 shall expire at the end of two years from the date on which the consumer informed the seller of the material defect.
If the existence of a defect in the goods is not disputed, the company must comply with the consumer's request as soon as possible, but no later than within eight days. If the existence of a defect in the goods is disputed, the undertaking must reply in writing to the consumer's request no later than eight days after receipt of the request.
