The General Terms and Conditions of Business and Use of the website www.brandspot.si (hereinafter: entuziast.si or KSHAMA d.o.o.) are drawn up in accordance with the Consumer Protection Act and other legislation applicable to sales via the Internet and this way of doing business.
These Terms and Conditions govern the operation of brandspot.si and the business relationship between KSHAMA d.o.o. ("KSHAMA d.o.o.") and the purchasers of goods or services ("Purchasers").
1. General about brandspot.si
The entuziast.si online shop is dedicated to the sale of products. You can find out more about the online shop itself HERE.
2. Accessibility of information
The Supplier undertakes to provide the following information to the Buyer at all times:
- the identity of the company (name and registered office, registration number),
- contact details that allow the user to communicate quickly and efficiently (email, phone),
- the essential features of the goods or services (including after-sales service and guarantees),
- product accessibility (every product or service offered on the website should be accessible within a reasonable time),
- the terms of delivery of the product or service (method, place and time of delivery),
- all prices must be clearly and unambiguously stated and it must be shown whether they already include taxes and transport costs,
- method of payment and delivery,
- an explanation of the complaints procedure, including full details of the contact person or customer service.
3. Supply and origin
In certain cases, due to the nature of the business, the offer on the brandspot.si online shop may change on a daily basis. All prices are final unless expressly stated otherwise. The company IS taxable and all prices are subject to VAT. Prices are valid at the time of placing the order and have no pre-determined validity. Prices are valid in the case of payment by the above payment methods, under the above conditions.
The purchase contract between the provider and the buyer is concluded at the moment when the provider confirms the order (the buyer receives an e-mail with the Order Confirmed status). From that moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.
Campaigns
Discounts are not cumulative, unless otherwise stated in the Promotion Terms and Conditions. One promotional code can be used for each purchase. Promotional codes cannot be applied to items that are already discounted to further reduce the price of the items or the final price in the basket.
Imaging and graphics
Photographs, images or recordings published in the context of the Offers are the property of KSHAMA d.o.o. or its suppliers or business partners.
Product opinion
The Provider is not responsible for the content of the reviews written by visitors. The Provider shall review the reviews before publication and reject those that are manifestly untrue, misleading or offensive. The Provider is not responsible for the information contained in the reviews and disclaims any liability arising from the information contained in the reviews.
4. Purchase procedure and invoice
KSHAMA d.o.o. acts as a company offering goods or services via the internet.
The buyer pays the amount to KSHAMA d.o.o. and receives an invoice together with the goods or services. The company operates in the territory of the Republic of Slovenia. Products are shipped to the territory of the Republic of Slovenia. In order to take care of the environment, we have introduced a system of electronic invoices, which are sent to the customer by e-mail. The customer can also receive a printed invoice if he notifies us by e-mail info@brandspot.si.
The postage price also includes all other handling and cash transfer costs, so the courier may not charge you any additional fees upon delivery. Your payment amount will be the amount you received on the confirmation invoice in your e-mail.
Purchase procedure
Ordering a product starts by selecting the products offered by clicking on the "View product" button in the online shop. You will then be taken to the product page, where you can select the quantity you want and, for some products, other characteristics such as size and colour. Once you have selected the desired quantity and other characteristics, you can proceed with the purchase by clicking on the "Add to basket" button. If you want to add other products you do it in the same way, but if this was the only product you wanted to buy you press "Show basket".
All products, their quantity and their price are clearly displayed here. It also shows the delivery or postage costs, as well as the total amount of the purchase. If you want to change something, you can change the quantity on the basket page, if you want to change another feature, you need to remove the wrong product from the basket, which you do by pressing the cross on the left of the product image. You can then go back to the shop and find the product you want, select the correct characteristics and add it to the basket again. Then, on the basket page, check that all the details are correct and agree with them, then proceed to checkout by pressing the "Proceed to checkout" button.
On the checkout page, you fill in the necessary details and see a summary of your total order with prices and delivery costs. Once you have entered all the necessary information (marked with *) and selected your delivery method and payment, complete your purchase by pressing the "Buy Now" button. You can interrupt the order process at any time by closing the browser window, unless you have already confirmed your order by clicking on the "Place Order" button. Purchase status
Order in the queue:
After placing an order, the customer receives an email notification that the order has been accepted into the queue. At this step, the customer has the possibility to cancel the order within one hour. The Buyer shall have access to comprehensive information on the status and content of the order at all times on the Supplier's website.
Order confirmed:
If the Buyer does not cancel the order, the order will be processed further, at which point the Supplier will review the order, check the deliverability of the items ordered and confirm or reject the order with a reason. The Provider may call the Buyer on the Buyer's contact telephone number to verify the information or to ensure the accuracy of the delivery. Upon confirmation of the order, the Supplier shall inform the Buyer by e-mail of the estimated delivery time.
Returning items
The consumer has the right to notify the company (email: info@brandspot.si) within 14 days of taking delivery of the goods that he/she wishes to withdraw from the contract, without having to give a reason for his/her decision. For the purpose of withdrawing from the contract, the buyer shall use the following model withdrawal form. The deadline starts 2 days after the date of receipt of the ordered goods. The only cost to be borne by the consumer in connection with withdrawal from the contract is the cost of returning the goods (which, in the case of shipping, is charged according to the delivery service's price list). The goods must be returned to the seller no later than 14 days from the date on which the message of withdrawal from the contract (purchase) was sent.
Exclusion of the right of withdrawal
1. Consumers do not have the right to withdraw from contracts:
the delivery of sealed goods that are unsuitable for return for health or hygiene reasons, if the consumer has opened the seal after delivery;
when buying food, if the packaging is open or damaged;
goods or services whose price depends on fluctuations in markets beyond the control of the entity that may occur within the withdrawal period;
goods that are made to the consumer's precise instructions and tailored to his or her personal needs;
goods which, because of their nature, are unsuitable for return, perishable or quickly
the expiry date;
on the supply of sealed audio or video recordings and computer programs, if the consumer has opened the security seal after delivery;
the supply of goods which, by their nature, are inextricably mixed with other items;
the supply of digital content which is not delivered on a tangible medium, provided that the supply of the service has been initiated on the basis of the consumer's prior express consent and acquiescence.
2. The consumer must return the product received undamaged and in the same quantity, unless the product has been destroyed, spoiled, lost or reduced in quantity without any fault on the part of the consumer. The consumer may not use the products after withdrawal from the contract.
3. The consumer may inspect and test the products to the extent strictly necessary to establish the actual condition of the product. The consumer shall be liable for any diminution in the value of the goods if the diminution is the result of handling which is not strictly necessary to establish the nature, characteristics and functioning of the goods.
Abuse of purchase
Once the order is placed, the customer receives a notification to the email address entered. The order is then accepted into the queue. The buyer has the right to withdraw from the distance contract within the period until the goods are dispatched (the order must be cancelled by e-mail to info@brandspot.si ). It is obligatory to enter the order number. The email address from which you cancel the order must match the email address used to confirm the purchase. If the customer does not cancel the order, the order will be processed further. The Supplier may call the Buyer's contact telephone number to verify the information or to ensure the accuracy of the delivery. Upon confirmation of the order, the Provider shall inform the Buyer by e-mail of the estimated delivery time. The contract for the purchase of the ordered items between the Buyer and the Provider is irrevocably concluded at this stage. The prices are valid at the time of placing the order and have no pre-determined validity.
Purchase security
When registering on entuziast.si, data is collected on the basis of the individual's personal consent after The law and the European Data Protection Regulation. KSHAMA d.o.o. undertakes to store this data carefully and securely for the purpose of the smooth execution of orders or the personalized compilation of offers, statistical analysis and for the purpose of improving the operation of the online shop and services.
5. Registration procedure
Users can place an order on brandspot.si in the online shop as a guest or as a logged-in user. The registration process is easy and quick. By logging in to the website, you create your own account through which you can edit your details, shipping addresses, view, track and edit order statuses.
Your username consists of the email address you enter. You will then receive a confirmation email to complete your registration. Registering on the website also gives you a better overview of your purchase.
6. Communication
The Provider will contact the User by means of distance communication only if the User does not expressly object.
The advertisement emails will contain the following elements:
- they will be clearly and unambiguously identified as advertising messages,
- the sender will be clearly visible,
- various campaigns, promotions and other marketing techniques will be labelled as such. The conditions for participation in them will also be clearly defined,
- a clear explanation of how to opt-out of receiving advertising messages,
- the user's wish not to receive advertising messages will be explicitly respected by the provider.
Users will be able to subscribe to and unsubscribe from the newsletter in an easy way. The newsletters include information about current or future offers, casper.si promotions and other advertising messages from casper.si or its partners. The receipt of notifications is deemed to require personal consent and is not possible unless the user indicates this when registering or otherwise opts in to receive them.
7. Disclaimer
Providers shall use their best endeavours to ensure that the information published on their websites is up-to-date and correct. However, the characteristics of the items, the delivery date or the price may change so quickly that the supplier is unable to correct the information on the websites. In such a case, the provider will inform the customer of the changes and allow him to cancel the order or replace the ordered item.

8. Buyer's right
It is understood that the purchase on the entuziast.si online shop is made via a Distance Contract. The language in which the contract is concluded is Slovene.
In the case of distance contracts, the consumer has the right (under Article 43c of the Consumer Protection Act) to notify the company within fourteen (14) days that he/she is withdrawing from the contract, without having to give a reason for his/her decision. The only cost to be borne by the consumer in connection with withdrawal from the contract is the direct cost of returning the goods if he/she sends them by post. If the consumer withdraws from the contract, our company will reimburse the payment received immediately or, at the latest, within 14 days of receipt of the withdrawal notice.
If the Buyer fails to pay the amount or the advance payment due under the preliminary invoice, as security for the seriousness of the conclusion of the transaction, at the Seller's request, the Buyer shall be deemed not to have accepted the offer and the contract shall not have been concluded. KSHAMA d.o.o. shall immediately inform the buyer thereof.
9. Discounts and discount codes
If brandspot.si prepares promotions with a special price or discount code for its customers, the promotions are mutually exclusive, unless otherwise stated. Promotions and discount codes are valid for items distributed by KSHAMA d.o.o., unless otherwise stated.
